TERMS OF SALE
These Terms of Sale apply to purchases of goods from the AVANGARDE online store (www.avangarde.ee).
The AVANGARDE online store is owned by Netaspect OÜ (registry code 10787879), located at Ravi 27, Tallinn, Harjumaa 10138.
1. Validity of the Sales Agreement, Product and Price Information
These terms apply when purchasing goods from the online store www.avangarde.ee.
The prices of products sold in the online store are indicated next to the products. The price is subject to an additional charge for delivery. All prices are in euros (€) and include VAT.
Information about the products is provided in the online store next to each product.
2. Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The total amount payable will then be displayed, which can be paid securely via the following payment solutions:
- Estonian bank payments
Payments are processed by Maksekeskus AS. Payments are made outside the online store in a secure environment: for bank link payments, in the secure environment of the respective bank, and for credit card payments, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank or credit card data. The contract comes into force once the amount due has been credited to the online store’s bank account.
The owner of the online store is the data controller for personal data and forwards the personal data necessary for payment processing to the authorized processor, Maksekeskus AS.
If the ordered goods cannot be delivered due to being out of stock or for any other reason, the buyer will be notified as soon as possible and any paid funds (including delivery costs) will be refunded promptly, but no later than 14 days from the date of notification.
3. Delivery
Goods are delivered to the following country: Estonia.
The buyer has the following options for receiving the goods: Omniva, DPD, SmartPost.
The cost of delivery is borne by the buyer and relevant information is displayed next to the delivery method.
Domestic shipments in Estonia generally arrive at the destination specified by the buyer within 1–5 business days after the sales contract comes into force.
In exceptional cases, delivery may take up to 14 calendar days.
4. Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of withdrawal, the ordered goods may only be used to the extent necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as allowed for testing the goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the online store has the right to reduce the refund amount in proportion to the decrease in the value of the goods.
The product must be unused and in its original packaging (except in the case of a defective product). Refunds will be made to the same account from which the purchase was paid, no later than 14 days after the returned goods have been received.
To return the goods, the buyer must submit a statement of withdrawal by sending a clear email to: kaja.aljas@gmail.com within 14 days of receiving the goods, indicating the order number and the product to be returned.
If you wish to return a product, you can do so in two ways:
- By Post
Pack the product carefully and, if possible, include the invoice or order confirmation. The shipping costs are borne by the customer unless the reason for return is an incorrect or defective product.
- In-Person Return at the Showroom
Products can also be returned at our Avangarde showroom at Ravi 27, Tallinn. Please arrange an appointment in advance by email. Our staff will assist you with the return quickly and conveniently.
The cost of returning the goods is borne by the buyer, except when the reason for the return is that the product does not conform to the order (e.g. wrong or defective product).
The buyer must return the goods within 14 days after submitting the withdrawal notice or provide proof that the goods have been handed over to the carrier within that period.
Upon receiving the returned goods, the online store will promptly, but no later than 14 days from receipt of the withdrawal notice, refund all payments received from the buyer under the contract.
The online store may withhold the refund until it has received the returned goods or until the buyer has provided evidence that the goods have been returned, whichever occurs first.
If the buyer has expressly chosen a delivery method other than the least expensive standard delivery offered by the online store, the online store is not obliged to reimburse the additional cost exceeding the standard delivery cost.
The online store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been mistakenly marked significantly below the market price.
5. Right to Submit a Complaint
The online store is liable for any non-conformity or defect of goods sold to the buyer, which existed at the time of transfer of the goods and which becomes apparent within two years of the transfer. Within the first year from the transfer of the goods to the buyer, it is presumed that the defect existed at the time of delivery. It is the responsibility of the online store to rebut this presumption.
The buyer must notify the online store of any defect no later than two months after becoming aware of it by sending an email to: kaja.aljas@gmail.com
The online store is not liable for defects that arise after the goods have been handed over to the buyer.
If goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the online store will refund the buyer all fees associated with the sales contract.
The online store will respond to consumer complaints in writing or in a format that can be reproduced in writing within 15 days.
6. Direct Marketing and Processing of Personal Data
The online store uses the personal data entered by the buyer (including name, phone number, email address, and postal address) solely for processing the order and delivering the goods to the buyer. The online store forwards personal data to the transport service provider for delivering the goods.
7. Dispute Resolution
If the buyer has any complaints regarding the online store, they should be submitted via email to kaja.aljas@gmail.com
If the buyer and the online store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. You can review the procedural conditions and submit an application here. The Consumer Disputes Committee has the authority to resolve disputes arising from contracts concluded between the buyer and the online store. The examination of the buyer’s complaint by the committee is free of charge.
The buyer may also turn to the European Union’s online dispute resolution platform.
